3.Mr.P.Suresh Srinivasan, the learned counsel enters appearance for the 2nd respondent, the Insurance Company.
4.Heard both sides. This petition stands allowed.
5.Learned counsel for the 2nd respondent submitted that the Insurance Company has filed C.M.A.No.2528 of 2023 and it is yet to be posted before the Division Bench.
6.The Registry is now required to number this appeal if the papers are otherwise in order and list the matter for admission on 17.10.2023.
