C.M.P.Nos.19232 and 13527 of 2022 in S.A.No.677 of 2022 P.T.ASHA, J ., The appellant did not have the benefit of an injunction against the 2nd defendant (who is the petitioner in C.M.P.No.19232 of 2022), as the 2nd defendant was made a party to the proceedings only in the year 2009 through orders in the implead petition in I.A.No.102 of 2009 dated 05.01.2010. The injunction was granted only against the 1st defendant on 05.01.2010 though the 2nd defendant was impleaded by them. The suit was ultimately dismissed and in the appeal also there was no injunction orders against the defendants. Ultimately the appeal was dismissed, as against which the second appeal has been filed.
2. Considering the fact that there is no interim order through out the proceedings against the 2nd defendant, the interim injunction granted on 24.08.2022 stands vacated.
3. In view of the interim injunction vacated today, C.M.P.No.13527 of 2022 stands dismissed.
