Respondents Prayer: This Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus directing the official respondents especially the 6th respondent to consider the petitioner representation dated 01.08.2024 and consequently, direct the respondents to provide earmarked space for petitioner association for selling fire crackers during Diwali festivals based on the previous orders of this Hon'ble Court.

ORDER

This petition has been filed seeking a direction to the 6th respondent to consider the petitioner representation dated 01.08.2024 and consequently, direct the respondents to provide earmarked space for petitioner association for selling fire crackers during Diwali festivals based on the previous orders of this Hon'ble Court.

2. The petitioner Association had made a representation before the respondents to allocate specific number of shops exclusively for the petitioner association to safeguard their interest in selling the fire crackers as assured by the Government Officials and also directed by this Court in WP.No.25870 of 2013 dated 07.10.2013 and the same has not been considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the 6th respondent to consider and pass orders on the petitioners' representation within the stipulated time as fixed by this Court.

4. The learned Additional Advocate General appearing for the respondents submitted that the 6th respondent will consider and pass orders on the petitioners representation within the stipulated time as fixed by this court.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the

limited request sought for by the petitioners, this Court directs the 6th respondent to consider the petitioners representation dated 01.08.2024 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 20.09.2024 rli To
