The plaintiff, whose suit for specific performance, which was dismissed is on appeal.

2.The plaintiff seeks an order of injunction restraining the respondents from alienating the property.

3.It is seen that a charge sheet has been created for repayment of advance amount. It is made clear that any alienation will be subject to result of the appeal, in view of the Section 52 of the Transfer of Property Act.

Hence, this petition is dismissed.
