ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent to file and register the First Information Report for complaint dated 13.04.2016 made by the petitioner on the file of the respondent herein, viz., Mohanur Police Station, Namakkal District bearing CSR No.49/2016.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. https://hcservices.ecourts.gov.in/hcservices/

It is represented by the learned Additional Public Prosecutor that the petitioner lodged a complaint with the respondent police and on the said complaint, the petition enquiry is pending in CSR No.49/2016.

Recording the submission of the learned Additional Public Prosecutor, the second respondent is directed to conduct enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner.

5. This Criminal Original Petition is disposed of with the above direction.
