ORDER

Challenging the impugned order dated 04.07.2025 passed in Crl.M.P.No.464 of 2024 in Crl.A.No. Nil of 2024 by the Principal District and Sessions Judge, Ranipet, the petitioner had preferred this Criminal Revision Case.

2. Before the trial court, the petitioner had filed a petition under Sec.5 of Limitation Act to condone the delay of 327 days in filing the Criminal Appeal and the same was dismissed by the trial court stating that due to non-appearance of the petitioner, it was dismissed for default. Against which, he preferred this Criminal Revision Case.

3. The learned counsel for petitioner would submit that due to lack of communication, he is not able to appear on that day. However, the petition was dismissed for default, which was filed to condone the delay. He would submit that now he is ready to proceed with the matter and seeks one more opportunity. Accordingly, he prayed to set aside the findings of trial court and to allow this Crl.R.C.

Considering his submissions and in order to give one more opportunity, this Court is inclined to allow this Criminal Revision and to set aside the findings of Principal District and Sessions Judge, Ranipet rendered in Crl.M.P.No. 464 of 2024 in Crl.A. No. Nil of 2024. Accordingly, this Criminal Revision Case is allowed.
