[Order of the Court was made by J.Nisha Banu, J.] This petition is filed to condone the delay of 938 days in filing the Criminal Appeal against the judgment of the learned Special Judge(POCSO Cases), Tiruvannamalai, Tiruvannamalai District in Spl.S.C.No.51/2020 dated 06.02.2023

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the 1st and 2nd respondents.

3. Learned Additional Public Prosecutor would state that as per the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, notice has been served on the victim but she did not appear.

4. Considering the above submissions made and on being satisfied with the reasons stated in the affidavit filed in support of the petition, we are of the opinion that the delay may be condoned. Accordingly, the delay is condoned and the petition stands allowed.

5. Registry is directed to number the appeal and post it for admission in the regular course.
