ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.12.2022, for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) 1/4

of Narcotic Drugs and Psychotropic Substances Act, 1985, in connection with Crime No.221 of 2022, registered on the file of the respondent, seeks bail. 2.The petitioner herein was arrested on 22.12.2022 for the offences under Sections 8(c) r/w 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act for alleged possession of 4 kgs. of Ganja. Earlier, the petitioner was granted bail by this Court on 14.02.2023 in Crl.O.P.No.3171 of 2023. However, he was not able to comply the bail condition to deposit Rs.15,000/- into the credit of Advocate Clerks Association, Gudiyattam and to furnish blood relative surety for Rs.10,000/-. The bail condition was sought to be modified and subsequently, the same was modified to the effect that one surety should be close relative from Kerala.

The petitioner was unable to comply the said condition also. Thereafter, the petitioner had filed extension of time petition and the same was considered and granted extension of time vide order dated 27.11.2024. Thereafter without complying the order, the present bail petition is filed stating that the conditions imposed is onerous and impossible to comply with.

3.This Court on perusing the records finds that petitioner hails from Kerala. He has been arrested for possession of 4 kgs. of Ganja, which is an intermediate quantity. Inspite of granting bail, there is no blood relative for him to stand surety and also not deposited Rs.15,000/-, which sought to be deposited while granting bail. The petitioner is in prison since 22.12.2022, i.e., nearly 2 1⁄2 years.

4.In view of the above fact, this bail petition stands dismissed. Considering the nature of the crime and the period of incarceration undergone by the petitioner as under trial prisoner, this Court directs the trial Court to expedite and complete the trial within a period of four months from today. 21.08.2025 rsi 3/4
