ORDER

This Writ Petition has been filed seeking a direction to the respondents to return the original certificates submitted by the petitioner at the time of her admission to the Postgraduate course, namely M.D. (Microbiology), in the third respondent college. 2.

The petitioner, after completing her undergraduate degree, was allotted a seat under the All India Quota for PG degree in Microbiology course in the third respondent college. The petitioner joined the course in the third respondent college and completed it on 06.05.2019. At the time of her joining, she executed a two year bond undertaking to serve in the Government Hospital/Institutions upon completion of the course.

Though the petitioner completed her postgraduate degree on 06.05.2019, she was not issued any posting order, and the respondents failed to provide employement in any Government Hospital. The petitioner waited for 18 months without joining any job. Subsequently, the petitioner offered a job in the 19th month, that too after completion of her course, as Covid duty. However, due to the family circumstances, the petitioner could not join the duty at that time. Consequently, the third

respondent college refused to return the original educational certificates. Therefore, the petitioner has filed the present writ petition before this Court.

By communication from the Principal's Office, Tirunelveli Medical College, Tirunelveli, by Na.Ka.No.13854/maka3/2024, dated Nil....05.2025 (signed on 19.05.2025), it was stated that the compulsory bond period would be treated as completed after working 1 year 17 days. However, the petitioner had served only 4 months 14 days duty. Therefore, she was required to pay the bond of Rs.7,41,992/- for release of the original certificates.

Learned counsel for the petitioner submitted that the petitioner is ready and willing to deposit the said amount. 6.

Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent and also perused the materials available on record.

In view of the above, the petitioner is directed to deposit the

said sum of Rs.7,41,992/- to the following Head of Account: "Retention of Unclaimed/receipts from medical/Dental College Students towards Bond Amount Fees 235 Writes off and Gains - 05 - Unclaimed/Forfeited Bonds (IFHRMS DP Code 021003-800-AB-23505)", On production of the acknowledgment of such deposit before the third respondent college, the third respondent college is directed to forthwith return all the petitioner's original educational certificates. 8.

With the above observations and directions, the Writ Petition is disposed of. No costs.
