Today, the matter is listed under the caption 'For being mentioned'. 2.The learned Special Public Prosecutor filed his counter and submitted that the petitioner sought for return of documents, which were seized from him on 19.09.2009. All the documents pertaining to the seizure on 19.09.2009 had been returned but now the petitioner seeks return of documents, which were seized on 17.09.2009 from one Sivashankar, Section Engineer, DSL Loco Shed, Tondiarpet, Chennai, a neighbour of the petitioner residing at No.10, Anna Street, Tharamani, Chennai - 600 113. 3.The learned counsel for petitioner submitted that these documents are not relied on documents by the prosecution, which has not been filed in the trial. In view of the above, the petitioner is directed to get appropriate affidavit from Sivashankar and thereafter the petitioner's plea can be considered.
