PRAYER:

Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Mandamus directing the 4th respondent to consider the petitioner's representation dated 18.04.2022 within a stipulated time as fixed by this Court and pass orders. O R D E R

This writ petition is filed for issuance of Writ of Mandamus directing the 4th respondent to consider the petitioner's representation dated 18.04.2022.

2. The case of the petitioner is that the petitioner inherited the subject property from his father-in-law. The grievance of the petitioner is that there was a Cart Track in the survey number relating to the subject property and the same was encroached. Hence the petitioner approached the revenue authorities and also paid a necessary fees to inspect and demarcate the Cart Track. However no action was taken, due to which the petitioner gave representation to all the respondents on 18.04.2022 and the first respondent sent a communication on 25.05.2022 to the 4th respondent 2/6

to take appropriate action, however no action was taken. Hence the petitioner has filed this writ petition.

4. The learned counsel for the petitioner submits that all the residents of the area are facing inconvenience for ingress and regress. Further the drainage facilities and any other amenities were not proper. However it would be suffice if this Court issues a direction to the third and fourth respondents to consider the petitioner's representation dated 18.04.2022 within a stipulated time as fixed fixed by this Court. Hence prays this Court for appropriate orders.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without going into the merits of the case, directs the 3rd and 4th respondents to consider the petitioner's representation dated 18.04.2022 and pass orders after affording reasonable opportunity of hearing to the petitioner as well as necessary 3/6

parties if any, within a period of twelve weeks from the date of receipt of a copy of this order.

7. With the above terms, this present writ petition is disposed of. No costs.
