ORDER
In this writ petition, the petitioner has challenged the assessment order dated 22.06.2022. and summary of the order dated 22.06.2022 passed by the respondent.
2. By the impugned order, the respondent has confirmed the tax demanded/proposed in show cause notice dated 16.02.2022, to which, the petitioner has also replied. However, after the reply was filed by the petitioner, the respondent has passed the impugned assessment order without giving the petitioner an opportunity of personal hearing. The impugned order has not recorded any of the contentions of the petitioner in the reply filed.
3. Considering the above, the impugned assessment order and summary of the order dated 22.06.2022 passed by the respondent are hereby set aside and the matter is remitted back to the respondent to pass fresh orders on merits within a period of 45 days from the date of receipt of a copy of this order. The first hearing of the case is fixed on 16.08.2023, on which date, the petitioner shall appear before the respondent, who shall thereafter pass orders on merits and in accordance with law, after affording the petitioner an opportunity of personal hearing, within the aforesaid period.
4. With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petitions are disposed of. 26-07-2023 msr Index:Yes/no Internet:Yes/No Speaking order/non speaking order
