Seeking leave to sue the respondents 1 and 4 to 6, the applicant/plaintiff has come up with this application. 2.The applicant is the plaintiff in the suit filed for partition and separate possession of the properties.

3.Mr.S.Vijayakumar, learned counsel for the applicant would submit that item No.I of 'B' schedule property is situated within the jurisdiction of this Court. Further the plaintiff and the respondents 2 and 3 are residing within the jurisdiction of this Court while the respondents 1 and 4 to 6 are residing outside the jurisdiction of this Court. Therefore, cause of action has arisen within the jurisdiction of this Court.

4.Considering the submission made by the learned counsel for the applicant and also considering the averments made in the plaint, leave is granted.
