ORDER

This writ petition has been filed to direct the 1st Respondent Bank to execute and register the Discharge Receipt pertaining to the registration of Memorandum of Deposit of Title Deeds dated 05.05.2005 (Doct. N.1695 /2005) in SRO, Thirukalukundram.

2. The learned counsel for the petitioner would submit that in this case, the petitioner had settled the entire loan amount to the respondents. However, no discharge certificate is issued by the respondents till date. Hence, this petition.

3. In reply, the learned counsel appearing for the respondent would submit that the petitioner had not paid the entire due amount and hence, the respondents are not in a position to execute and register the discharge receipt as requested by the petitioner. Hence, he prays for dismissal of this petition.

4. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the petitioner to produce entire documents with

regard to the settlement of loan amount before the respondents. Upon receipt of the said documents, the respondents are directed to verify the same and ascertain as to whether the entire loan amount has been paid by the petitioner. If so, the respondents shall issue the discharge certificate to the petitioner in accordance with law.
