ORDER

Challenging the impugned order passed by the I Addl. Sessions Judge, City Civil Court, Chennai in Crl.A.No. 382 of 2023 confirming the order passed by the FTC II Metropolitan Magistrate, Egmore, Allikulam in C.C.No. 2799 of 2018, the petitioner/accused preferred this Criminal Revision Petition.

2. The petitioner herein is the accused in C.C.No. 2799 of 2018 on the file of learned FTC II Metropolitan Magistrate, Egmore, Allikulam and he was found guilty of offence under Sec.138 of Negotiable Instruments Act. He has been convicted and sentenced to undergo simple imprisonment for a period of six months. Aggrieved by the same, he had filed an appeal in Crl.A.No. 382 oof 2023 before the I Addl. Sessions Judge, City Civil Court, Chennai, which wass also dismissed by confirming the findings of trial judge. Aggrieved by the same, the present Criminal Revision case has been filed.

3. The learned counsel for respondent appeared and submitted that the conditional order passed by this court has not been complied. The learned counsel for petitioner seeks some more time and agreed to settle the issue. 2/4

4. Heard both sides.

5. On seeing the facts, as on date, this court had noticed that the petitioner has not complied the conditional order passed by this court while suspending the sentence as agreed by the petitioner. Therefore, on seeing the conduct of petitioner, the order of suspending the sentence passed by this court on 24.09.2025 is cancelled and the petitioner is directed to surrender before the trial court.
