This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 63 days in filing the above Criminal Revision Case against the order dated 28.02.2025 passed in Crl.A.No.382 of 2023, on the file of I Addl. Sessions Judge, City Civil Court, Chennai confirming the order passed by FTC-II, Metropolitan Magistrate Judge, Egmore,Allikulam in C.C.No.2799 of 2018 dated 29.03.2023.

2. The learned counsel for petitioner submitted that as he is a senior citizen, he was suffered with age old ailments and since he is depending upon the alms of his family members, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of July 2025, he gave papers to him, as a result of which, there is a delay of 63 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
