PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to return the tipper lorry bearing Regn.No.TN-31-AE-2049, which was seized on 1.10.2016 by the officials of the second respondent and kept in Panruti Police Station. Mr.S.Diwakar, learned Special Government Pleader accepts notice for the respondents. Heard both. By consent, the writ petition itself is taken up
(2) for final disposal.
2. The petitioner seeks a direction to the respondents to release the vehicle namely the tipper lorry, which has been seized on 1.10.2016.
3. According to the petitioner, the said vehicle has been used to remove the unwanted earth and alleging that the said vehicle was used for illicit mining, the second respondent seized the said vehicle and handed over to the fifth respondent.
4. Though the custody of the said vehicle is with the fifth respondent, the Competent Authority under the provisions of the Statute is the third respondent. Further, it is seen that the petitioner had given a representation dated 26.10.2016 to the third respondent.
5. In the light of the above, the writ petition is disposed of with a direction to the petitioner to enclose a copy of the representation dated 26.10.2016 along with a copy of this order and submit the same in person in the office of the third respondent. On such production, the third respondent shall consider the petitioner's representation dated 26.10.2016 on merits and pass appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. 24.11.2016 Internet : Yes RS
