Respondents Prayer: Writ Petition has been filed under Article 226 of the Constitution of India seeking for issuance of a writ of declaration to declare the calling of Bandh/Strike by the fifth respondent political party and its functionaries and office bearers to be held on 31.10.2022 or any other date in the Coimbatore District as illegal, unconstitutional and grossly in violation of dictum laid down by the Hon'ble Supreme Court of India in James Martin Vs. 1/4

State of Kerala 2004 (2) SCC 203 and consequently direct the respondents 1 and 2 to take appropriate preventive measures to stop calling of bandh / strike by any political party or organisation and pass such further orders.

(Order of the Court was delivered by The Hon'ble Acting Chief Justice) When the matter was taken up on 28.10.2022, this Court recorded the submission of Mr.R.C.Paul Kanagaraj, learned counsel for the fifth respondent, that no call as projected on behalf of the petitioner has been given by the fifth respondent.

2. Today, when the matter is taken up, again, Mr.R.C.Paul Kanagaraj, learned counsel for the fifth respondent, submitted that since the fifth respondent has not given any call for Bandh/strike as projected by the petitioner, nothing survives in this writ petition. Recording the said submission, the writ petition is closed as nothing survives for further adjudication. No Costs. Consequently, connected miscellaneous petitions are closed. (T.R., ACJ.)
