In continuation and conjunction to the earlier order passed by this Court on 11.10.2023, this Court is passing the following order. 2.Today, the learned counsel for the petitioner produced the proof affidavit and copy of the cheque.

3.From the evidence and materials, it is seen that nowhere, the respondent denied the signature in the cheque or issuance of the cheque, but taken a defence that the said cheque has been given to one Sundar. The respondent not took any steps to examine the said Sundar though he is aware that Sundar filed yet another case before the Small Causes Court, Chennai.

4.Finding reason and force in the submissions made by the learned counsel for the petitioner, this Court is inclined to grant leave. Accordingly, leave is granted.
