ORDER

The Writ Petition is filed for the below relief: " directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.06.2023 to 09.03.2025, in paying the amounts paid towards his terminal benefits namely EPF Employees contribution Gratuity and Earned leave within a time frame ".

2. The brief facts which are culminated in the filing of this Writ Petition are set out as below:

2.1. It is the case of the petitioner that he was working as a Junior Engineer with the Tamil Nadu State Transport Corporation from 05.01.1988 and subsequently transferred to Respondent Corporation. After completion of 25 years of service, the petitioner attained the age of superannuation on 31.05.2023. The retirement benefits namely EPF is worked out to the sum of Rs.12,48,961/-, Gratuity at Rs.16,01,596/-, Commutation payable for his service

period is calculated as Rs.9,42,77/- and finally, encashment of the earned leave is worked out as Rs.7,84,020/-.

The respondent has paid the terminal benefits only on 10.03.2025 by issuing cheque, however, only the principal amounts of the terminal benefits has been paid and the interest for the period of delay in paying the benefit has not been settled to the petitioner. The petitioner has sent a representation dated 11.04.2025 to the respondent requesting to pay the interest amounts towards the delayed payment of the terminal benefits. But, the same has not been considered by the respondent. The respondent has not settled come forward to settle the interest amounts to date. Hence, the petitioner is before this Court.

4. Heard the Counsels on either side.

5. Admittedly, the petitioner's retirement benefits has been paid almost after a delay of two years, for no fault of the petitioner. Therefore, the petitioner is entitled to interest on the same. Had the retirement benefits being issued to the petitioner earlier he could have invested the same, and earned interest thereby making the nest for himself in the post retirement stage. Therefore, the Writ petition is allowed as prayed for and the respondent are hereby directed to

pay the petitioner, interest at the rate of 18% per annum for the period of delay from 01.06.2023 to 09.03.2025 in paying the amounts paid towards his terminal benefits namely EPF Employee's contribution, Gratuity and Earned leave within a period of one (1) month from the date of receipt of copy of this order. No costs.
