ORDER

The Writ Petition is filed for the below relief: " directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.07.2023 to 15.04.2025, in paying the amounts paid towards her terminal benefits namely EPF Employee's contribution, Gratuity, EL and Commutation within a time frame ".

2. The brief facts which are culminated in the filing of this Writ Petition are set out as below:

2.1. It is the case of the petitioner that she was working as a Senior Superintendent in the Respondent Corporation from 25.05.1987. After completion of 37 years of service, the petitioner attained the age of superannuation on 30.06.2023. The retirement benefits namely EPF is worked out to the sum of Rs.8,50,278/-, Gratuity at Rs.19,19,949/-, Commutation payable is Rs.10,66,859/- and encashment of the earned leave is worked out as Rs.3,53,399/-.

3. The respondent has paid the terminal benefits only on 16.04.2025 by

issuing cheque, however, only the principal amounts of the terminal benefits has been paid and the interest for the period of delay in paying the benefit has not been settled to the petitioner. The petitioner has sent a representation dated 28.04.2025 to the respondent requesting to pay the interest amounts towards the delayed payment of the terminal benefits. But, the same has not been considered by the respondent. The respondent has not settled come forward to settle the interest amounts to date. Hence, the petitioner is before this Court.

4. Heard the Counsels on either side.

5. Admittedly, the petitioner's retirement benefits has been paid almost after a delay of two years, for no fault of the petitioner. Therefore, the petitioner is entitled to interest on the same. Had the retirement benefits being issued to the petitioner earlier she could have invested the same, and earned interest thereby making the nest for herself in the post retirement stage. Therefore, the Writ petition is allowed as prayed for and the respondent is hereby directed to pay the petitioner, interest at the rate of 18% per annum for the period of delay

from 01.07.2023 to 15.04.2025 in paying the amounts paid towards her terminal benefits namely EPF Employee's contribution, Gratuity, EL and Commutation within a period of one (1) month from the date of receipt of copy of this order. No costs.
