PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the 2nd and 3rd respondents to consider the claim of the petitioner to upload and issue the online version of the community certificate to the three minor daughters of the petitioner as per law, within a stipulated time period. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.
2. When the matter comes up for hearing, learned State counsel would submit that, though the community certificate was issued to the daughters of the petitioner, the enquiry regarding the base document on the basis of which it was issued is going on.
3. Doubt with regard to the community certificate would lead to an enquiry by the Caste Scrutiny Committee. However, we are informed by learned counsel for the petitioner that the Caste Scrutiny Committee has already made an enquiry.
4. Learned State counsel would submit that a copy of the report of the Caste Scrutiny Committee may be placed by the petitioner before the Revenue Divisional Officer, second respondent herein.
5. We would also observe that once the Caste Scrutiny Committee has given its finding, the Sub-Collector is bound to act according to the same and cannot raise further doubt on the entitlement of the petitioner's daughters. This should be done as early as possible, preferably within a period of two weeks from the date of production of the report of the Caste Scrutiny Committee by the petitioner.
