The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 379 and 430 of I.P.C r/w Section 21(1) of the Mines and Minerals (Development & Regulation) Act, in Crime No.405 of 2023, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioners along with other accused were found in illegal transportation of 1⁄4 unit of river sand in a bullock cart. Hence, the case.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioners along with other accused have illegally transported 1⁄4 unit of river sand in a bullock cart. Hence, he opposed to grant anticipatory bail to the petitioners.
5. Heard the learned Counsel for the petitioners and the learned Government Advocate (crl.side) and perused the materials available on record.
6. Considering the facts and circumstances and as per directions of the Hon'ble Supreme Court regarding illegal sand mining, smuggling and theft of sand and minerals, I am not inclined to grant anticipatory bail to the petitioners.
