O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) and 29 of NDPS Act, 1985 in Crime No. 559 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioner along with other accused persons were in illegal possession of 2 kgs of ganja. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case based on the confession statement of one of the co-accused. He submits that no recovery has been made from this petitioner. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioner is having bad antecedent and four previous cases were pending against him which are similar in nature. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case, nature of allegations, taking note of the submissions made by learned counsels on either side, considering the fact that the petitioner is having four previous cases which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 16.09.2025 nr To 1.The XV Metropolitan Magistrate, George Town, Chennai.
