(Made by N.ANAND VENKATESH, J.) The earlier petition filed by the petitioner seeking suspension of sentence and bail was considered on merits and the same was dismissed by this Court on 11.04.2022. The petitioner/A-4 has filed this petition seeking suspension of sentence once again and we do not find any ground to entertain this petition. In fact, we find that the chief-examination of the victim girl was done on 07.01.2016 and she was not cross-examined immediately. On the contrary, she was recalled on 03.08.2018 for cross-examination. We do not approve this tactics adopted by the defence.

2. When we were about to dismiss this petition on merits, the learned counsel for the petitioner sought permission of this Court to withdraw this petition and he also made an endorsement to that effect.

3. In view of the endorsement made by the learned counsel for the petitioner, this petition is dismissed as withdrawn. [P.N.P., J.] [N.A.V, J.] 06.12.2022 gya/25 P.N.PRAKASH, J.
