C O M M O N O R D E R The petitioners, who were arrested at the hands of the respondent police on 14.12.2024 for the alleged offences under Sections 406, 420,

120(B), 34 of IPC and 5 of Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997 in Crime No.236 of 2024 seeks bail.

The case of the prosecution is that as per the F.I.R., the defacto complainant one K.Saravanan had invested an amount of Rs.1,50,000/- on 21.02.2023 and 14.02.2023 respectively in a Company called Silver Line (Plexus Business Solutions Company). All the accused asked him to invest money in the crypto currency of the said company, for which they had been given two cheques dated 28.02.2023 and 14.03.2023 respectively, which were returned. Investigation revealed that the petitioners along with other accused received Rs.81,50,000/- from 21 persons and cheated them. Hence the case.

3. The learned counsel for the petitioners submitted that various firms and various persons invested in the private firm and these petitioners are not connected with these firms. He further submitted that the petitioners are falsely implicated and they are suffering incarceration from 30.07.2025. He also submitted that the petitioners are ready to abide by any stringent

condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

4. The learned Government Advocate (Crl.side) submits that the investigation is at initial stage. These petitioners joined with other accused registered a Company, in which these petitioners are Directors. They collect investments from various persons, by engaging Accused No.3, by promising that, investors will get Rs.30,000/- per month, if they invest Rs.1,00,000/-. Further, they organised various events to collect investments. Now, many of the accused are absconding and so far, no money is recovered. He further submitted that if the petitioners are granted bail, there is a possibility of absconding and tampering with the evidences and also threatening the witnesses, which would create hardship to proceed with the investigation of this case. Therefore, he strongly opposed for grant of bail and anticipatory bail to the petitioners.

5. In view of the facts and circumstances of the case, this Court is of the opinion that investigation in this case just started, no money is so far recovered, and if the petitioners are granted bail, there is a possibility of

K.RAJASEKAR kmm absconding and tampering with the evidences and also threatening the witnesses. Hence, this Court is not inclined to grant bail to the petitioners.
