The petitioner, who is arrayed as the fourth accused, was arrested on 15.03.2016 and remanded to judicial custody on 16.03.2016 for the alleged offence under Sections 341, 395, 397, 427 r/w 506(ii) of IPC, in Crime No.19 of 2016 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that on 15.03.2016 at about 6.30 a.m., the petitioner along with other accused waylaid the complainant and threatened him with dire consequences and on knife point taken away a sum of Rs.1,550/- from his pocket and flew away from the scene of occurrence.

3.Heard both sides.

4.The learned counsel for the petitioner submits that the petitioner is innocent and would further submit that this case is a foisted one with Rs.1,550/- and P.T. Warrant has been issued and he was arrested and would further submit that the petitioner is having permanent residence and therefore, prays that the petitioner may be enlarged on bail.

bbr/srn 5.The learned Additional Public Prosecutor has no serious objection.

6.Considering the facts and circumstances of the case, duration of the custody and the fact that the petitioner is also having permanent residence, this Court is inclined to grant bail with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- [Rupees Ten thousand only] with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Salem and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m., for a period of one month.
