The petitioner seeks bail in C.C.No.566 of 2024 on the file of the II Additional Special Judge for Exclusive Trial of cases under NDPS Act at Chennai in Crime No.35 of 2024 for the alleged offence punishable under Section 8(c) r/w 20(b)(ii)(c) and 29(1) of NDPS Act, on the file of the respondent police.

2.The case of the prosecution is that the petitioner along with other accused had purchased 30 kgs of Ganja from andhra Pradesh which is a commercial quantity. Hence the complaint.

3.The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. He would further submit that the petitioner is no way connected with the said occurrence.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police would contend that the quantity involved in this case is commercial in nature. He further submitted that investigation has been 1/3

completed and charge sheet also filed. He also submitted that this Court has already dismissed the bail application of the petitioner vide order dated 02.09.2024 in Crl.O.P.No.21309 of 2024. Hence, he opposed to grant bail to the petitioner.

5.Heard both side and perused the materials available on record. 6.Considering the fact that the quantity involved in this case is commercial in nature and taking note of the fact that this Court dismissed the earlier bail application filed by the petitioner in Crl.O.P.No. 21309 of 2024 dated 02.09.2024 and now there are no change in circumstances, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition stands dismissed. 25.09.2024 smn 2/3
