PRAYER: The Criminal Original Petition is filed under Section 528 of The Bharatiya Nagarik Suraksha Sanhita, 2023, praying to modify the Bail conditional order passed by the Principal Sessions Judge, Chennai in Crl.M.P.No.24459 of 2024 dated 02.09.2024, on condition that the petitioner shall report before the said Court on all working days at 10.30 a.m, until further orders in Crime No.262 of 2024 on the file of the respondent police.

ORDER

This petition has been filed seeking to modify the condition imposed in the order dated 02.09.2024 in Crl.M.P.No.24459 of 2024 passed by the Principal Sessions Judge, Chennai.

2. When the matter is taken up for hearing, learned counsel appearing for the petitioner submitted that the Sessions Court, Chennai has granted bail to the petitioner on 02.09.2024, on condition that he should report before the said Court on all working days at 10.30 a.m. until further orders. He further submitted that petitioner came from poor family and he is the only bread winner of their family, due to which, the petitioner was unable to satisfy the condition imposed by the Sessions Court. Therefore he filed this petition for modification.

3. Since, the condition was imposed by the Sessions Court while deciding the petitioner's application for bail, it is appropriate to direct the petitioner to seek appropriate remedy before the Court below in the manner known to law.

In view of the above, this Criminal Original Petition stands dismissed.
