The Criminal Original Petition has been filed, seeking a direction to the 3rd respondent police to provide police protection to the petitioner based on the complaint dated 22.09.2022 and 21.10.2022.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents 1 to 3.
3. The learned counsel appearing for the petitioner submitted that there was a land dispute between the petitioner and the respondents 4 to 7 with regard to the enjoyment of pathway. In this regard, she was assaulted by the respondents 4 to 7 and she had given a complaint on 22.09.2022. The grievance of the petitioner is that on the said complaint, no action has been taken and there is a danger for the personal safety. 2/5
4. The learned Govt. Advocate (Crl.Side) submitted that on the complaint given by the petitioner on 22.09.2022, enquiry has been conducted in C.S.R No.326 of 2022 and that has been closed as civil in nature. However, the petitioner had sent another complaint dated 21.10.2022 and for which CSR No.371 of 2022 has been assigned and the enquiry is still pending.

Since the subsequent complaint is also for the very same allegation, the 3rd respondent can have no other option, except to close the same in the same line on which the earlier complaint was disposed. The petitioner who is said to have got aggrieved due to the action on the part of respondents 4 to 7, is at liberty to file a civil suit and get appropriate orders from the Court. If the 3rd respondent police finds out the commission of any criminal offence, it is needless to state that appropriate action should be taken in accordance with law. 3/5
6. With the above observation, this Criminal Original Petition is disposed of.
