A.No.5303 of 2022 in TOS.No.8 of 2006 G. CHANDRASEKHARAN, J.

This application is filed to record the death of the sole plaintiff and implead the applicant as 2nd plaintiff in TOS.No.8 of 2006.

2. It is submitted by the learned counsel for the plaintiff that the sole plaintiff namely Mr.C.Rajendran was the executor of the Last Will and testament of late Mr.S.K.Kuppusamy dated 15.06.2001. During the pendency of the suit, the sole plaintiff died and the applicant is the wife of the sole plaintiff. Therefore, she has to be impleaded as 2nd plaintiff in the suit for continuation of the proceedings.

3. The learned counsel for the respondents have no objection for allowing this application.

4. Considering the facts of the case and reasons stated in the affidavit and the submissions of the learned counsel for the applicant and having satisfied with the reasons for impleadment, this application is allowed.

5. Plaintiff is directed to take steps for making appropriate amendment in the plaint and file amended plaint.
