The above Miscellaneous Petition is filed to condone the delay of 1979 days for filing the Restoration Petition in W.P.No.12657 of 2001 which was dismissed for non-prosecution on 26.03.2014.

2. Mr.A.N.Thambidurai, learned Additional Government Pleader appearing for the respondents has no objection for the delay being condoned. However, he would submit that considering the long delay of 1979 days, a reasonable cost may be imposed for condoning the delay.

3. In view of the above, the delay is condoned on condition that the petitioner shall pay a sum of Rs.1,000/- to the Legal Services Authority, Madras High Court. The learned counsel for the petitioner paid the said amount to the Legal Services Authority, Madras High Court and produced the receipt of the same before this Court and the same is verified. The delay is condoned.
