The Criminal Original Petition has been filed, seeking a direction to the respondent not to harass the petitioners, under the guise of enquiry.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the respondents 1 & 2.

The learned counsel appearing for the petitioners submitted that for a money due, due to business transaction, the 3rd respondent/de-facto complainant continues to give complaints against the petitioners before the several police stations; despite the complaints have been closed as civil in nature by various police stations, the de-facto complainant has given yet another complaint before the 2nd respondent police and for which, the petitioners are being summoned to make their appearance in person; the 3rd respondent abuses the process of law by giving frivolous complaint and on the basis of which, the petitioners are being harassed by the respondents.

4. The learned Government Advocate (Crl. Side) submitted that on the complaint given by the 3rd respondent, current paper is opened and the enquiry is pending in C.No.239 of 2021. If at the end of the enquiry, it comes to light similar complaints have been filed and the same were closed as civil in nature, the present complaint can also be closed in the same line.

5. However, the petitioners are at liberty to file their written explanation instead of making their personal appearance, unless their personal appearance is indispensable.

6. In view of the above observation, this Criminal Original Petition is disposed of, with a direction to the respondents 1 & 2 to complete the enquiry in C.No.239 of 2021, within a period of two weeks from the date of receipt of a copy of this order.
