O R D E R
The Criminal Original Petition has been filed, seeking a direction to the 4th respondent not to harass the petitioner in view of the complaint of 5th to 7th respondents.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents 1 to 4.
3. The learned counsel for the petitioner submitted that a money transaction between herself and the respondents 5 to 7 have been exaggerated and criminal complaints were given and on which the petitioner is being harassed by the respondent police.
4. The learned Government Advocate (Crl. Side) submitted that the respondents 5 to 7 have given three different type of complaints on the allegations of money transaction and other facts and on which current 2/4
paper enquiry is opened in C.Nos.231, 241 & 350 of 2022 and the enquiry is pending. Only after the conclusion of the enquiry, it can be known whether the transaction involved is only civil in nature or not.
5. When a complaint is given, it is the duty of the 4th respondent to make a preliminary enquiry. But, no FIR has been registered against the petitioner so far. That itself will show that the enquiry is being done only in accordance with law by opening a current paper. So, the petitioner need not apprehend any unlawfulness and can make her appearance and submit the material available with her.
6. With the above observation, this Criminal Original Petition is closed with a direction to the 4th respondent to complete the enquiry in C.Nos.231, 241 & 350 of 2022, within a period of two weeks from the date of receipt of a copy of this order.
