Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the 2nd respondent herein to consider and pass orders on the petitioner's representation dated 08.09.2016 submitted to grant separate patta for the petitioner's property bearing Survey No.237/2 measuring about 16.2/3 cent situated at Alangadu Village, tiruthuraipoondi Taluk, Tiruvarur District. ORDER

Heard the learned counsel for the petitioner and Mr.R.S.Selvam, learned Government Advocate who accepts notice on behalf of the respondents and with the consent on either side, the writ petition is taken up for final disposal. The case of the petitioner is that the petitioner had purchased 16 2/3 cents of land comprised in Old s.No.237/2, situate at Alangadu village, Thiruthuraipoondi Taluk, Tiruvarur District, on 11.08.1969 from his vendor by way of a registered Sale Deed bearing Doc.No.1061/1969 dated 11.08.1969, registered at the office of the Sub Registrar, Muthupettai. of purchase, the petitioner is in absolute possession and enjoyment of the same. While so, the petitioner had applied for issuance of separate patta in favour of the petitioner in respect of the said land to the 2nd respondent. Since no response was forth coming, the petitioner had once again sent a representation to the 2nd respondent on 08.09.2016. Though the said representation was received and acknowledged, the 2nd respondent has not initiated any action, which made the petitioner to send a representation to the 1st respondent on 23.09.2016 and the 1st respondent had forwarded the said representation to the Revenue Divisional Officer, Mannargudi, with a copy marked to the 2nd respondent herein, to take action on the application and report the same to the 1st respondent.

Despite the same, the 2nd respondent is yet to take steps on the representation of the petitioner. Therefore, the petitioner is before this Court, with the present writ petition. Considering the limited scope of prayer sought for by the petitioner and without going into the merits of the same, this Court directs the 2nd respondent to consider and pass orders on the petitioner's representation dated 23.09.2016 on merits and in accordance with law and pass orders as expeditiously as possible and communicate the decision taken, to the petitioner. The writ petition stands disposed of with the above direction. No costs.
