Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, to direct the respondents to disburse the i) Terminal benefits namely Gratuity, Earned leave salary, unearned leave salary, provident fund, family pension, Family Insurance Amount, Reimbursement of Medical Health Insurance amount of Rs.2,84,843 and other monetary benefits with prevailing rate of interest within a stipulated time fixed by this Court based on the petitioner's representation dated 22.01.2022.

ORDER

This Writ petition has been filed for a mandamus seeking for a direction to the respondents to disburse the terminal benefits namely Gratuity, Earned leave salary, unearned leave salary, provident fund, family pension, Family Insurance Amount, Reimbursement of Medical Health Insurance 2/6

amount of Rs.2,84,843 and other monetary benefits with prevailing rate of interest, within a stipulated time fixed by this Court.

2. Heard the learned counsel for the petitioner. Mr.G. Ameedius, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3 and Mr.K. Tamilvendan, learned counsel, accepts notice on behalf of the respondents 5 to 7. By consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The petitioner is the wife of the deceased employee late K.Narayanan, who was working as an Office Assistant in the first respondent/Society. The petitioner claims that the retirement benefits of the deceased employee late K.Narayanan, has not been paid till date despite several representations given by the petitioner. The last such representation was given on 22.01.2022.

4. No prejudice will be caused to the respondents if the petitioner's representation is considered by the respondents on merits and in accordance with law, within a time frame to be fixed by this Court. 3/6

For the foregoing reasons, this Court directs the 2nd respondent to pass final orders on merits and in accordance with law, on the petitioner's representation dated 22.01.2022, seeking for disbursement of the terminal benefits namely Gratuity, Earned leave salary, unearned leave salary, provident fund, family pension, Family Insurance Amount, Reimbursement of Medical Health Insurance amount of Rs.2,84,843 and other monetary benefits with prevailing rate of interest, which according to the petitioner was payable to late K.Narayanan, within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. With the aforesaid directions, this Writ Petition is disposed of. No costs.
