Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 & 2 to disburse the compensation amount in S.F.Nos.141/2A, 138/3A & 138/4A situated at Sirukundram Village, Thiruporur Taluk, Chengalpattu District to the petitioners within a time frame to be fixed by this Court. The petitioners herein seeks a direction to the respondents 1 & 2 to disburse the land acquisition compensation amount in respect of the land situated in S.Nos.141/2A, 138/3A & 138/4A at Sirukundram Village, Thiruporur Taluk, Chengalpattu District, within a time frame fixed by this Court.
2. It is the case of the petitioners that the above mentioned 2/5
property was originally allotted to the first petitioner's husband and the second petitioner's father late Veerabatran in a family partition deed dated 14.12.1987 and after his death, the petitioners have been in possession and enjoyment of the same. The respondents acquired the subject property and till date no compensation amount has been paid. Therefore, the petitioners are before this Court.
3. When the matter is taken up for hearing, the learned Special Government Pleader, who takes notice for the respondents 1 & 2, on instructions would submit that the revenue documents of the subject property is in the name of the private respondents 3 to 5. In view of the rival claim made by the petitioners, the first respondent would refer the matter for the decision of the Civil Court under Section 21 of the State Highways Act. The said statement made by the learned Special Government Pleader appearing for the respondents 1 & 2 is recorded.
4. Recording the same, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 3/5
