Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the petitioner representation under section 23 of the Puducherry settlement act, 1970 in connection with restoring the settlement register for the properties situated in revenue village No.40, Ward-B, Town 1/4

Survey No.7 Pt. (old R.S.181/2 PT and 181/1PT) as Ryotwari in the name of Victor Jegannatha Mudaliar as stood in resurvey records which was mistakenly now reflecting as GP with remarks "Theru" within time frame that may be fixed by this Court.

This writ petition has been filed for direction to the respondents to consider the petitioner's representation under section 23 of the Puducherry Settlement Act, 1970 in connection with restoring the settlement register for the properties situated in revenue village No.40, Ward-B, Town Survey No.7 Pt. (old R.S.181/2 PT and 181/1PT) as Ryotwari in the name of Victor Jegannatha Mudaliar as stood in resurvey records which was mistakenly now reflecting as GP with remarks "Theru" within time frame that may be fixed by this Court. 2.

It is seen that on receipt of the representation submitted by the petitioner, the third respondent issued notice to conduct enquiry. That apart, the third respondent directed the surveyor concerned to survey the subject property and to submit a report.

In view of the above, the third respondent is directed to consider the petitioner's representation and, after issuance of notice to the petitioner and counter parties, if any, and giving them opportunity of personal hearing, to pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of this order. 5.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.
