For Petitioner(s): Mr.R. Bharath Kumar For Respondent:

ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the respondents 1 to 3 to deal with the representation made by the petitioner on 19.07.2025 wherein the petitioner has requested for an alternative location for conducting the flag hoisting event on 15.08.2025, on behalf of Ex-servicemen welfare association.
2.
Heard Mr.R. Bharath Kumar, learned counsel for the petitioner and Mr.G.Velu, learned Additional Government Pleader
for Respondents 1 to 3.
3.
It is quite unfortunate that there is some dispute between two groups and therefore, the other group is preventing the hoisting of National Flag during the Independence day. Even during the Republic day, there was some dispute and it required the interference of the police and the revenue officials. Ultimately, a settlement was arrived at between the parties. Inspite of the same, flag hoisting was not possible on 26.01.2025. 4.
In view of the above, a representation has been made by the petitioner to the official respondents to ensure that the flag hoisting event goes on in a peaceful manner. Since the same was not considered, the present writ petition has been filed before this Court. 5.
Taking into consideration the facts and circumstances of the case and to ensure that the flag hoisting event goes on in a peaceful manner, there shall be a direction to the 3rd respondent to call the parties for an enquiry and ensure that the Flag hoisting event goes on in a peaceful manner without giving rise to any law and order problem. This Court expects both parties not to fight under
the National Flag fluttering and it must only be remind them the sacrifice done by many leaders and freedom fighters for getting freedom for this Country. It will be an insult if the two groups fight during the flag hoisting event. Better sense must prevail. 6.
This writ petition is disposed of in the above terms. No costs.
