O R D E R

The present petition has been filed seeking bail in P.R.C.No.16 of 2009, pending on the file of the Judicial Magistrate No.II, Alandur.

2. The case records indicate that Crime No.94 of 2001 was registered for the offences under Sections 307, 308 and 511 of I.P.C. against two persons. Due to their abscondence, there was no progress in the investigation for several years.

3. On completion of the investigation, the case was taken on file as P.R.C.No.88 of 2001 by the Judicial Magistrate-I, Poonamallee and later transferred to the Judicial Magistrate-II, Alandur and renumbered as P.R.C.No.16 of 2009. In the meantime, the petitioner failed to appear before the Court on 16.02.2016, resulting in the issuance of a Non-Bailable Warrant, pending till 16.06.2025. Meanwhile, the co-accused had also died. In such circumstances, the petitioner was secured on execution of the NBW and is now before this Court seeking bail.

4. Considering the conduct of the petitioner and the nature of the case, this Court is not inclined to grant bail at this juncture. Accordingly, this Criminal Original Petition is dismissed with a direction to the respondent police to take appropriate steps to report the death of A2 before the Magistrate Court and seek committal of the case to the Court of Sessions. Once the case is committed to the Sessions Court, it will be open to the petitioner to renew the petition for bail.
