..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents to pass an award by re-determining the amount of compensation in accordance with section 28A of the Land Acquisition Act, 1894, in the light of Judgment and Decree dated 30.09.2019, passed in L.A.O.P.No.242/ 2002 on the file of the Principle Subordinate Court, Namakkal, with respect to the land acquired from the Petitioner herein, comprised in S.Nos.36/5A2, 36/5A7 and 36/5A9 admeasuring a total extent of 0.09.5 hectares, situated in, Marurpatti Village, in Namakkal Taluk based on the representation of the Petitioner dated 01.02.2020 sent to the 1st Respondent.

ORDER

This writ petition is filed to direct the respondents to consider the petitioner's representation dated 01.02.2020.

Learned counsel for the petitioner would submit that the petitioner has made a representation dated 01.02.2020 to pass an award by re-determining the amount of compensation in accordance with Section 28A of the Land Acquisition Act, 1894, in the light of Judgment and Decree dated 30.09.2019, passed in L.A.O.P.No.242/2002 on the file of the Principle Subordinate Court, Namakkal, with respect to the land acquired from the petitioner herein, comprised in S.Nos.36/5A2, 36/5A7 and 36/5A9 admeasuring a total extent of 0.09.5 hectares, situated in, Marurpatti Village, in Namakkal. However, the said representation was not considered, as on date. Hence, this writ petition.

3. Learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation dated 01.02.2020 will be considered within a period of 12 weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to dispose of the petitioner's representation dated 01.02.2020 on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the aforesaid direction, this writ petition stands disposed of. No costs.
