Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent to issue patta in respect of petitioner's property at No.24/1 (New No.53), Harrington Road, Chetpet, Chennai - 600 031 comprised in R.S.No.324 Old S.No.65, measuring an extent of 1 Ground 976 sq.ft bounded on the North by Harrington road, South by Plot No.2, East by Plot No.2 and on the West by S.No.323/3 and 323/2 together with building thereon within a time frame as may be fixed by this Court.

O R D E R

The petitioner herein seeks a direction to the respondent to issue patta in respect of petitioner's property at Door no.24/1 (New No.53), Harrington Road, Chetpet, Chennai - 600 031 comprised in R.S.No.324 Old S.No.65, measuring an extent of 1 Ground 976 sq.ft. by considering his on-line application dated 20.02.2024.

2. By consent of both the learned counsel appearing for the petitioner as well as respondent, this writ petition is disposed of at the admission stage itself.

3. It is the case of the petitioner that he acquired right over the above mentioned property under registered partition deed dated 25.02.1978. He submitted an on-line application dated 20.02.2024 seeking issuance of patta in his name and the same has not been considered till date. Therefore, the petitioner is before this Court.

4. Mr.A.M.Ayyadurai, learned Government Advocate, who takes notice for the respondent would submit that the on-line application of the petitioner will be considered on its own merits and appropriate orders will be passed.

In view of the above submission made by the learned Government Advocate, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the respondent to consider the online application of the petitioner dated 20.02.2024 and pass final orders, on merits and in accordance with law, after affording reasonable opportunity to the petitioner and other interested parties, within a period of six weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
