Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the first and second respondents to take action against the traffic violation by regulating and prohibiting the lorry traffic between 8 AM and 6 PM from entering the Thayar Sahib street, Anna Salai, Chennai-2 and direct the third respondent to remove the garden garbage shed and the encroachment by making way for foot path for pedestrain walking.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) One more case of municipal chaos! We wonder at times as to how much of municipal governance supervision which we are called upon to do, when the concerned authorities do not act despite the representations and even if some action is taken, conveniently the original position comes back in a couple of days.

2. We do not propose to guide the Police and the Corporation as to how they have to perform their duties as that is their job. It is for them to see that there are proper arrangements. We grant fifteen days time for the concerned authorities to remedy the position and to continue to monitor the same.

3. The compliance report be filed, including as to what steps were taken earlier on the complaint of the petitioner and what steps are being taken to ensure that after the sanity is restored, once again it is not permitted to deteriorate into the original position. The concerned officer should also look into as to why no remedial measures were taken on the various representations of the petitioner and to fix the responsibility.

4. The writ petition, accordingly, stands disposed of. No costs.
