ORDER

Till date, counter has not been filed in the interlocutory applications.

2. The applicant /plaintiff is having the benefit of an interim injunction order in O.A. Nos.663 to 665 of 2024, since 23.09.2024. 1/3

Even though it is represented by both the learned counsels that the parties are exploring the possibility of settlement, no useful purpose would be served, if these applications are allowed to be kept pending. Being a Commercial Suit, counters will have to be filed in the interlocutory applications at the earliest.

Since counter has not been filed till date in the interlocutory applications and the applicant is having the benefit of the interim order, since 23.09.2024, the interim injunction granted by this Court is made absolute and these applications are allowed as prayed for. However, the interim injunction is made absolute, without prejudice to the rights and contentions of the respondent / defendant in the main suit.

4. A. No.4788 of 2024 has been filed seeking to combine the cause of action. The learned counsel for the respondent / defendant has not raised any serious objection for allowing this application, without prejudice to the rights and contentions of the defendant in the main suit.

5. This Court is also satisfied with the reasons contained in the affidavit filed in support of A. No.4788 of 2024 as sufficient cause has been shown by the applicant /plaintiff. Accordingly, A. No.4788 of 2024 is allowed as prayed for.
