This Criminal Original petition has been filed seeking to enlarge the petitioner on bail in respect of Crime No.220 of 2022 registered for the offence under Sections 328 of Indian Penal Code read with Section 24(1) of COTPA Act, on the file of the respondent Police.
2. The case of the prosecution is that, the petitioner along with other accused was found in possession of 30 kg banned tobacco products. Hence, the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and false case has been registered against him. He would further submit that the petitioner is in custody from 15.10.2022 and he is ready to comply with any stringent condition imposed by this Court and hence, he prays for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioner is an habitual offender having seven previous cases pending against him, out of which, four are similar in nature. Hence, he opposed for grant of bail to the petitioner.
5. Taking into consideration the submissions made by the learned Government Advocate (Crl.Side) and also considering the bad antecedents of the petitioner and further the petitioner was arrested very recently ie from 15.10.2022., this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition stands dismissed for the present.
