Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondent herein to consider and pass orders on merits and in accordance with law on the petitioner's representation dated 18.06.2024 with regard to cancellation of the minor punishments and promotion to the post of Special Sub Inspector of Police on par with his batch mates within a time frame. The Writ Petition is filed for the following relief: "directing the respondent herein to consider and pass orders on merits and in accordance with law on the petitioner's representation dated 18.06.2024 with regard to cancellation of the minor punishments and promotion to the post of Special Sub Inspector of Police on par with his batch mates within a time frame".

The petitioner submits that he joined the Police Department as Grade II Police Constable in the year 1999 and he was promoted as Grade I in the year 2012 and further he was promoted as a Head Constable. The petitioner has received about 15 rewards and he was subjected to three minor punishments in the year 2008 and 2013 and maintaining a good record of service other than the mentioned above. 2/7

3. The petitioner submit that he is an eminent sports person in the Tamilnadu Police Department. The petitioner won several Gold Medals in the National Police Sports Championships. The petitioner had represented Indian Police Team to the International Masters Sports Championships held at Malaysia on 27.09.2023 and won Gold Medal in Discus Through, Bronze Medal in Shot Put. The petitioner's sports achievements was appreciated by the Tamilnadu Police Department.

4. The petitioner submits that he was due for promotion to the post of Grade I Police Constable in the year 2009 but the same was delayed for three years. The petitioner was not allowed to undergo sports training in the year 2009 and 2010. Hence, the petitioner had availed medical leave. However, leave was denied and this caused great prejudice to the petitioner's promotion to the post of Special Inspector of Police in the year 2024.

5. The petitioner submits that in a similar circumstances earlier orders were passed in the respondent department to cancel the minor punishments and to drop minor disciplinary proceedings so as to enable the Police personnel to get their promotion without reference to their minor punishments.

The petitioner submits that stating all the above reasons the petitioner had submitted a representation to the first respondent on 18.06.2024 and requested to cancel the minor punishments and promote him to the post of Special Sub Inspector of Police on par with his batch mates. But till date no orders have been passed on the petitioner's representation.

7. The petitioner humbly submits that the representation preferred by the petitioner is maintainable under Rule 15 A of the Tamil Nadu Police Subordinate Service (Discipline and Appeal) Rules. Since there is no response to his representation, the petitioner has filed this Writ Petition.

8. Heard the learned counsels on the either side and perused the records.

9. A perusal of the records would show that the petitioner has sent his representation as early as on 18.06.2024. However, to date the representation has not been considered by the respondent. Therefore, the respondent is directed to consider the representation of the petitioner and pass orders on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.

10. The Writ Petition is allowed. No costs.
