Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the respondents to construct the overhead water tank at Oozhaman Kadu village, Chinna Soragai Panchayat, Mettur Taluk, Salem District based on resolution No.14 of the 6th respondent and the representation of the petitioner dated 26.12.2015 forthwith.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) We cannot entertain this public interest litigation, as at which location should the overhead water tank be. It is the case of the petitioner that the overhead water tank is being constructed in another village, though the Panchayat had passed a resolution for the village in question - Oozhaman Kadu Village. This falls within the administrative domain.

2. However, the respondent authorities may look into the issue whether another overhead water tank is required for Oozhaman Kadu village, as seems to be the grievance of the petitioner.

3. The writ petition is dismissed with the aforesaid observation. No costs.
