O R D E R

Alleging the violation of the orders of this Court made in W.P.No.13482/2016 dated 12.04.2016, the present contempt petition has been filed.

When the matter is called, the learned Counsel for the petitioner submitted that instead of paying a sum of Rs.1,36,835/- towards interest on Gratuity, the respondents have paid only Rs.20,823/- and the balance amount of Rs.1,16,012/- is yet to be paid.

In reply, the learned Standing Counsel for the respondents submitted that the respondent Transport Corporation started making part payment of gratuity from May, 2016 till 24.05.2017 and the entire amount was paid on the said date. Subsequently, interest on the rate of 6% was also paid. But the petitioner is demanding interest on interest.

Under such circumstances, this Court is of the view that this matter can be examined if the petitioner files an application under Section 33 (c) (2) of the Industrial Disputes Act, before an appropriate Labour Court within a period of two weeks. Granting such liberty, the Contempt Petition is closed.
