This writ petition has been filed to direct the respondents 1 and 2 to consider the petitioner's representations, dated 11.08.2023 and
01.09.2023, for revising their Scale of Pay and for other reliefs. 2.It is the case of the petitioners that they were appointed as Scavengers vide G.O.Ms.No.47, School Education (R1) Department, dated 02.03.2012 and their Pay Scale was fixed as Rs.1,300 - 3000 + Grade Pay Rs.300/-. Pursuant to the orders of this Court, the Government passed G.O.(Ms) No.50, School Education Department, dated 08.03.2019, fixing regular Time Scale of Pay to the Scavengers as Rs.4,800 - 10000 + Grade Pay of Rs.1,300/-. However, it is the grievance of the petitioners that they have been receiving only the old salary and their Scale of Pay has not been revised so far as per G.O.(Ms) No.50. Hence, the petitioners submitted representations, dated 11.08.2023 and 01.09.2023, for revising their Scale of Pay and for other reliefs. Since the same were not considered, the present writ petition has been filed.
3.Heard the learned counsel for the petitioner. 4.Mr.E.Vedabagath Singh, learned Special Government Pleader, who takes notice for the respondents 1 and 2, submits that the 2nd respondent is the competent authority, however, the petitioners have
submitted their representation to the Chief Secretary to Government. If the petitioners submit a fresh representation to the 2nd respondent, the 2nd respondent will consider the same on merits.
5.In view of the submission made by the learned Additional Government Pleader and considering the limited nature of relief sought for in the present writ petition, the petitioners are directed to submit a fresh representation to the 2nd respondent within a period of two weeks and on receipt of such representation from the petitioners, the 2nd respondent shall consider the same on merits and in accordance with law and pass appropriate orders within a period of two months thereafter. 6.With the above directions, this writ petition is disposed of. No costs.
