Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the 1st respondent in his proceedings No.A/3786/2014 dated 10.11.2014 and quash the same, there by directing the respondents to reinstate the petitioner in service with all benefits.

O R D E R

The prayer sought for in this Writ Petition is to call for the records of the 1st respondent in his proceedings No.A/3786/2014 dated 10.11.2014 and quash the same, there by directing the respondents to reinstate the petitioner in service with all benefits.

2. The case of the petitioner is that he joined the service of the respondent department as an Assistant in 1993. On 01.10.2010, the petitioner was promoted as Assistant Inspector of Labor. Thereafter, on 10.11.2014, the petitioner was issued https://hcservices.ecourts.gov.in/hcservices/

with a suspension order on a criminal offense. However, till date the Criminal case has not been proceeded with. Therefore, the Writ Petition has been filed.

3. The learned counsel appearing for the petitioner would submit that the petitioner has made representations to the respondents on 11.01.2019 and 03.07.2019 for revocation of suspension order dated 10.11.2014. However, the representations made by the petitioner were also not considered. The learned counsel would further submit that it would be suffice to issue direction to the respondents to dispose of the representation dated 03.07.2019 in accordance with law.

4. Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, this Court will not interfere with the impugned order dated 10.11.2014. However, I am inclined to issue direction to the respondents to consider the representation of the petitioner dated 03.07.2019 and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
